Terms and Conditions for Participation in snom technology AG’s XML Contest 2007
Terms and conditions of the snom XML-Contest
I. Purpose and Terms of Contest
snom technology AG is holding the following contest:
- The contest will begin on September 4th, 2007, and end on October 22nd, 2007, at 12 noon EDT (18:00 hours CET). During this time period all contestants registered with snom and fulfilling the eligibility requirements stated in Article II, below, are entitled to submit XML files to enter the contest.
For this purpose snom will set up a Wiki at http://contest.snom.com where each contestant will create his or her own page and submit one or more entries in the contest. Contestants must complete and send the entry form on the web page. Upon successful registration, contestants will receive an email with the access data to their account, i.e., user name and password for the Wiki, and will then be able to create their page.
After the contest has ended, the XML solution will continue to be publicized on the Wiki at http://contest.snom.com and thus keep promoting the recognition of participating programmers.
The XML program must be designed for the XML minibrowser of the four snom phones of the 3x0 series. Please refer to the Wiki entry at http://wiki.snom.com/minibrowser for format descriptions and guidelines to be used for submitted entries. - There will be two separate contests, one for business applications and one for lifestyle applications. Examples for business applications are services providing a calculator, a currency conversion program, or a technical dictionary, or entries supporting an operational function like opening the entrance door to the office building. Entries in the lifestyle category are applications without a business purpose or function like, for example, games or animations.
- Contestants agree to the publication of their XML programs under the terms of the BSD licence (see http://en.wikipedia.org/wiki/BSD_licenses). Contestants acknowledge that they will thereby make the source codes available to the public. Anyone may use and modify the source codes, but must retain the copyright notice of the original authors. The source codes can be downloaded from snom or a third party provider. If a script language like Perl or PHP is used, a link to a working demo must be provided.
- All entries must have been received by 12 noon EDT (18:00 hours CET), October 22nd, 2007. snom technology AG does not assume any liability for the accessibility of the contest web page or the loss or incompleteness of submitted data.
- By submitting an entry in the contest, the contestant agrees to the terms and conditions of participation. The contestant further affirms expressly that by submitting the entry he or she is not violating any rights of third parties and that he or she is the author of the entry.
II. Eligibility Restrictions
- The contest is open to all persons who are 18 years of age or older. Employees (and their family members) and agents of snom technology AG, its subsidiaries of affiliated companies may not enter the contest. This also applies to all companies sponsoring the contest.
- No purchase is necessary to enter or win the contest. A purchase will not increase your chance of winning. All entries in the contest are subject to these Terms and Conditions. Registrations must contain the contestant’s name, email address, preferred user name, and home address. The contestant agrees to the storage and use of this data for the purpose of participating in this contest. Contestants may submit any number of entries in the contest; multiple entries are expressly permitted.

III. Prizes
- In each category:

- Invitation, at snom’s discretion, either to the VON FALL 2007 in Boston or to the SIMO 2007 in Madrid, including travel arrangements, hotel accommodations, breakfast, and free entry to the expo.
- Second Prize:

1 x epygi Quadro2x box, sponsored by epygi - Category “Lifestyle Application”:
1 x Mobotix camera, sponsored by ABP Technology

- Third Prize:
- 1 x snom 370 with a snom Wireless headset adapter box and a GN Netcom or Plantronics wireless headset

- First Prize:
- The prizes are expressly limited to the items listed above and do not include taxes, customs duties, gratuities, or any other expense. There is no cash equivalent for prizes, except that snom technology AG, at its sole discretion, reserves the right to substitute prizes of comparable value or cash. If modifications or substitutions of prizes are made by manufacturers or contractors, snom technology AG will notify the winners accordingly. A transfer of the first prize in each category to another person is expressly excluded.
- By accepting the prize, the winner agrees to assume responsibility for any further actions (like costs) connected with it and exempts snom technology AG from any liability and claims by third parties. This includes, but is not limited to, claims for injuries and damages and loss incurred by persons and/or property in connection with a prize awarded by snom technology AG. This also applies to the travel arrangements and accommodations made by snom technology AG.
- The members of the jury are Dr. Michael Knieling, Tim Köhler, and Christian Baier.
- The decisions of the jury with respect to the contest are final and not subject to legal recourse.
- The winners will be announced on the Internet on October 29th, 2007. snom technology AG will try to notify all winners by email.
IV. Protection of Privacy and Miscellaneous Information
- Contestants expressly consent to the publication of their names, email addresses, and contest entries on the Internet. Contestants also expressly consent to their applications being made available to interested third parties for demonstration purposes.
